Jacobson, Director of Public Safety <br /> <br />CITY MANAGER'S APPROVAL: <br /> <br /> <br />Comments attached <br /> <br />No comments to su lement this re <br /> <br />Recommendation: <br /> <br />Approve the Resolution and Consent Order Imposing Civil Penalty for Ken's Market. <br /> <br />Legislative History: <br /> <br />None <br /> <br />Financial Impact: <br /> <br />Receipt of $1 ,000 civil penalty. <br /> <br />Explanation: <br /> <br />On 9 November 2005, the New Brighton Department of Public Safety Police Division conducted <br />alcohol compliance checks of all of our liquor licensees. During those compliance checks, two of the <br />eighteen current licensees failed the compliance checks selling alcoholic beverages to a person under the <br />age of 21. Ken's Market is one of the two licensees who failed the compliance check. The employee <br />who sold alcoholic beverages was charged with a Criminal Violation of Sale of Alcoholic Beverage to a <br />Person under the Age of 21, a gross misdemeanor. The employee has pled guilty to that offense in <br />Ramsey County District Court. <br /> <br />City Code also provides for administrative penalties for the license holder. This includes a civil penalty <br />of $1,000.00 for the first offense, $1,500.00 for the second offense within 24 months, and $2,000.00 <br />for the third offense within 24 months of the first offense. I have met several times with Ms. Obeera <br />Iqbal, President and Owner of Ken's Market. Ms. Iqbal has written new policies and has provided <br />training to her employees regarding conducting sales of alcohol and tobacco (attached). Ms. Iqbal has <br />been cooperative and has made no excuses for this violation. I believe that Ms. Iqbal is sincere and is <br />determined to eliminate or minimize future violations. Ms. Iqbal has agreed to the terms in the <br />attached consent order to include payment of the civil penalty, and the consent resolution has been <br />reviewed and signed by Ms. Iqbal.
