'l <br /> <br />RESOLUTION NO. 90-59 <br />- <br /> <br />" <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, <br />VN-279. <br /> <br />;1 <br />!I <br /> <br />WHEREAS, an application has been made by New Brighton Christian <br />Church; and <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance, VN -279, was filed with the City of New <br />Brighton on June 1, 1990. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on June 19, 1990, and all persons present at the <br />hearing were given an opportunity to be heard. <br />3. The City Council considered the application for VN -279 on June 26, <br />1990. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to VN-279: <br /> <br />1. The subject property is zoned R-1, Single Family Residential. <br />2. Churches and their accessory buildings are a special use within the <br />R-l district and must be setback 30 feet from all R-l property lines. <br />3. The church addition would be setback 21 feet from the north property <br />line. <br />4. The church addition would not border single family homes to the <br />north, but would border Hidden Oaks Park. <br />5. The church addition would have a minimal impact on Hidden Oaks <br />Park. <br />6. The subject site has limited buildable area, restricted primarily to the <br />northwest corner of the site, due to poor soils. <br />7. The applicant has demonstrated a unique and unusual circumstance <br />and undue hardship. <br /> <br />BE IT FURTHER RESOLVED, the application VN-279 is hereby approved <br />subject to the following conditions: <br /> <br />1.
