I <br /> <br />RESOLUTION NO. 90---5.lL <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />'; RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION <br />FOR A NONCONFORMING USE PERMIT NC-88. <br /> <br />WHEREAS, an application for a nonconforming use permit, NC-88, has been <br />made by New Brighton Christian Church to permit the construction of a 8,100 <br />square foot church addition on a site with Type IV non conformities . <br /> <br /> 1. <br /> 2. <br />,I <br />; 3. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />An application fora nonconforming use permit, NC-88, was filed with <br />the City of New Brighton on June I, 1990. <br />The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on June 19, 1990, and all persons present at the <br />hearing were given an opportunity to be heard. <br />The City Council considered the application for NC-88 on June 26, 1990. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to NC-88: <br /> <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br /> 6. <br /> 7. <br />!i <br />'I <br />/, 8. <br /> 9. <br /> <br />1. The following Type IV nonconformities exist on the property: <br />A. Lack of poured -in -place concrete curbing around all parking and <br />drive areas. <br />B. Parking area within front yard setback area. <br />C. Lack of adequate number of off-street parking stalls. <br />The subject site is zoned R -I, Single Family Residential. <br />Section 11-020 (b) of the Zoning Code requires poured-in-place concrete <br />curbing around all parking, drive, and maneuvering areas. <br />Section 11-020 (f) of the Zoning Code does not permit off-street parking <br />areas within the front yard setback in residential districts. <br />Section 11-030 (b) of the Zoning Code requires 93 off-street parking <br />stalls on the subject site. <br />The applicant proposes poured-in-place concrete curbing around <br />designated parking and drive areas. <br />In order to provide the required number of parking stalls on site, the <br />applicant does not propose to increase the front yard setback of the <br />existing parking lot. <br />The applicant proposes increasing the amount of off-street parking <br />stalls from 50 to 95 stalls which complies with City parking <br />requirements. <br />The applicant has eliminated and reduced the existing Type IV <br />nonconformities to the greatest extent practical. <br /> <br />BE IT FURTHER RESOLVED, the application NC-88 is hereby approved <br />" subject to the following conditions: <br /> <br />:i <br />
