<br />l..:. ; <br /> <br />! <br />II <br />" <br /> <br />RESOLUTION NO. 90- 33 <br /> <br />Ii <br />" <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-278. <br /> <br />WHEREAS, an application for a variance has been made by William Jafvert; <br /> <br />and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />" <br />" <br />, <br />ii <br /> <br />1. An application for a variance was filed with the City of New Brighton <br />on March 30, 1990. <br />2. The Planning Commissionpursuant to published and mailed notices, <br />held a public hearing on April 17 , 1990, and all persons present at <br />the hearing were given an opportunity to be heard. <br />3. The City Council considered the application for VN -278 on April 24, <br />1990. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to VN-278: <br /> <br />i, <br />, <br /> <br />1. The property is zoned R -1, Single Family Residential. <br />2, The required lot width in an R-1 district is 75 feet. <br />3. The proposed minor subdivision would create a 65 foot wide lot <br />(Lot 2) and an 85 foot wide lot (Lot 1). <br />4. The applicant is requesting a 10 foot lot width variance for Lot 2. <br />5. A slope runs north/south over proposed Lot 1 and east/west over <br />proposed Lot 2 causing a natural grade separation at a point 85 feet <br />from the north property line of proposed Lot 1 . <br />6. Proposed Lot 2 is developed with a single family home which would be <br />setback 25 feet from the proposed property line separating proposed <br />Lots 1 and 2. <br />7. Strict enforcement of the R-1 district lot standards would cause the <br />owner an undue hardship because of circumstances unique to the <br />individual property under consideration. <br />8, The plight of the landowner is due to circumstances unique to the <br />subject property not created by the landowner. <br />9. The requested 10 foot lot width variance would not alter the <br />essential character of the neighborhood. <br />10. The neighborhood, specifically 12th Avenue NW, is developed with <br />several principal and accessory structures which are in violation of <br />the R-l district front yard setback due to limited buildable lot area <br />caused by the steep slope which parallels Long Lake at this point. <br />11.
