<br />" <br /> <br />---.: ; <br /> <br />.. <br /><-. <br /> <br />RESOLUTION NO. 89-.J..L <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, <br />VN -275. <br /> <br />WHEREAS, an application for a variance has been made by Johnson <br />Filtration Systems, Inc.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New <br />Brighton on April 28, 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on May 16, 1989, and all persons <br />present at the hearing were given an opportunity to be heard. <br />3. An application for variance VN-275 was reviewed by the City <br />Council on May 23, 1989. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the <br />following Findings of Fact in respect to VN -275. <br /> <br />1. The subject property is zoned 1-2, Heavy Industrial. <br />2. The maximum building height in the 1-2 district is 40 feet. <br />3. The proposed addition would increase the height of the north <br />50 feet of the crane bay area from 40 feet to 60 feet. <br />4. The proposed addition would require a 20 foot height variance <br />from Section 6-060 (F) of the City's Zoning Ordinance. <br />5. The proposed addition would constitute 2% of the total roof <br />area of the Johnson Filtration Systems building. <br />6. The proposed addition would accommodate the assembly of a 40 <br />foot long filter which must be assembled upright on an 8 foot <br />high pedestal and must have 12 feet of clearance above the <br />filter for crane operation. <br />7. The intent of the 40 foot height restriction is to prevent any <br />structure from having a negative impact on surrounding land <br />uses. <br />8. The existing stand of mature trees along the east shore of <br />Rush Lake would serve to screen the proposed addition from <br />Long Lake Regional Park; the remaining uses are industrial, <br />therefore, the impact of the proposed addition would appear <br />to be minimal and be in keeping with the intent of Section 6- <br />060 (F). <br />9. The Johnson Filtration Systems Plant located in New Brighton <br />is the only plant in the United States with the potential of <br />accommodating the assembly of the 40 foot long filter. <br />10.
