' <br /> <br />~~ <br /> <br />.~ i <br />~'I <br />I <br />I <br />1 ~ <br />I <br />I <br /> <br />RESOLU:ION NO. 89-~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR <br />PLANNED UNIT DEVELOPMENT, PUD-4. <br /> <br />WHEREAS, an application for a Planned Unit Development entitled PUD-4 <br />has been made by Opus Corporation. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for Planned Unit Development PUD-4 was filed with <br />the City of New Brighton on March 24, 1989. <br /> <br />2. Such application was reviewed by the New Brighton Planning <br />Commission on April 4, 1989. <br /> <br />3. The City Council, pUrS(lant to published and mailed notices, held <br />a public hearing on April 11, 1989 and on April 25, 1989, and <br />all persons present were given an opportunity to be heard. <br /> <br />NOW THEREFORE BE IT RESOLVED, the New Brighton City Council makes <br />the following Findings of Fact ~n respect to PUD-4: <br /> <br />1. The subject site is approximately 4.3 acres in size and is <br />located generally south of 1-694 and north of 10th Street NW. <br /> <br />2. The subject site is presently vacant and zoned B-3, General <br />Business. <br /> <br />3. The adjacent properties to the south are zoned R-3B, Multiple <br />Family, the property to the east is zoned R-3A, Multiple Family, <br />and the subject site is bounded by 1-694 right-of-way to the <br />west and north. <br /> <br />4. The New Brighton Compf?hensive Plan designates the subject site <br />for General Business. <br /> <br />5. The proposed development would consist of a three-story office <br />building comprised of 72,000 square feet of floor area. <br /> <br />6. The proposed development would establish a landscape screen <br />along the east property line, adjacent to the R-3B residential <br />district, consisting of 34 spruce trees and a four foot high <br />berm. <br /> <br />7. The proposed development would be consistent with the adopted <br />Comprehensive Plan of the City. <br /> <br />8. The proposed development would be designed to form a desirable <br />and unified environment within its own boundaries in terms of <br />visual character, patterns of circulation, and sufficiency of <br />drainage and utilities, <br /> <br />9. The proposed developme~t would be compatible with present and <br />planned uses in the su~round area. <br /> <br />10. The exception to the B'-3 district height requirement allowing a <br />three-story structure to be constructed on the subject site <br />would be justified by the large setbacks, effective landscape <br />screening proposed, and general design of the development. <br /> <br />11. The burden or impact created by the proposed development on <br />parks, schools, street~, and other public facilities would be <br />minimal. <br />
