<br />'" <br /> <br />I" <br /> <br />RESOLUTION NO. 89-~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />,:RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE VN-271. <br /> <br />WHEREAS, an application for a variance has been made by Donatelle <br />;: Properti es. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New <br />Brighton on February 3, 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on February 21, 1989, and all <br />persons present at the hearing were given an opportunity to be <br />heard. <br />3. The application for VN-271 was reviewed by the City Council on <br />February 28, 1989. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />i Findings of Fact in respect to VN-271: <br /> <br />1. The subject site is zoned I-I, Light Industrial. <br />2. The subject site contains pockets of poor soils and is a long and <br />narrow corner lot with a great deal of street frontage and <br />separated from an R-IA district by 5th Street NW, resulting in <br />increased setbacks and limited buildable area. <br />3. Section 6-060 (a) requires all structures in the I-I district <br />which are separated from an R-IA district by a public street must <br />be setback 60 feet from said street right-of-way. <br />4. The proposed structure would be located 40 feet from the 5th <br />Street NW. <br /> <br />BE IT FURTHER RESOLVED, the application for VN-271 is hereby approved <br />subject to the following condition: <br /> <br />1.
