<br />RESOLUTION NO. 89- ~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING VARIANCE <br />VN-272. <br /> <br />WHEREAS, an application for a variance has been made by Fina Oil <br />Company. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New <br />Brighton on February 3, 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on February 21, 1989, and all <br />persons present at the hearing were given an opportunity to be <br />heard. <br />3. The application for VN -272 was reviewed by the City Council on <br />February 28, 1989. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the <br />following Findings of Fact in respect to VN -272: <br /> <br />1. The subject property is zoned B-3, General Business. <br />2. The required front yard setback for parking lots in the B-3 <br />district is 30 feet. <br />3. The subject site is a corner lot bounded by public streets and <br />residen tially zoned property. <br />4. The required parking setbacks for the subject site is 30 feet <br />from the public right-of-way and 25 feet from the residential <br />district line. <br />5. Ramsey County has required the subject site dedicate 17 feet of <br />right-of-way along Silver Lake Road and 16.5 feet of right-of- <br />way along County Road E. <br />6. The increased setbacks and additional right-of-way dedication on <br />the subject site together serve to reduce the amount of <br />developable area on the subject site. <br />7. The proposed site plan would require a 15 foot setback variance <br />for the off-street parking/maneuvering area along Silver Lake <br />Road. <br />8. The applicant has agreed to construct a 3 foot high berm along <br />Silver Lake Road and County Road E to reduce the impact of the <br />off-street parking/maneuvering area. <br />9. The requested 15 foot setback variance along Silver Lake Road <br />in conjunction with the establishment of a landscape berm and <br />proposed landscaping would allow for a reasonable use of the <br />subject site with minimal impact on surrounding land uses. <br />10. The applicant has demonstrated unique and unusual <br />circumstances and an undue hardship. <br /> <br />BE IT FURTHER RESOLVED, the application for VN-272 is <br />hereby approved subject to the following conditions: <br /> <br />1. Approval of LP-240. <br />2.
