<br />" <br /> <br />.... <br />- <br /> <br />'C" <br /> <br />RESOLUTION NO. 89-1.1.-. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE <br />VACATION OF A PORTION OF A DRAINAGE AND UTILITY EASEMENT <br />(LOCATED AT 1571 - 27TH AVENUE NW). <br /> <br />WHEREAS, the procedural history of the petition is as follows: <br /> <br />1. John Christianson, property owner, petitioned the vacation of a <br />portion of the subject drainage and utility easement on August <br />19, 1988. <br /> <br />2. The City Council, pursuant to published and mailed notices, <br />held a public hearing on February 14, 1989, and all persons <br />present at the hearing were given an opportunity to be heard. <br /> <br />3. The written comments and analysis of City Staff were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, the New Brighton City Council <br />makes the following Findings of Fact in respect to the proposed vacation: <br /> <br />1. The subject drainage and utility easement is located on property <br />at 1571 - 27th Avenue NW which is owned by John Christianson. <br /> <br />2. The portion of the drainage and utility easement to be vacated <br />is located on high, level ground which would not be used for <br />utility, drainage, flowage or pondage purposes. <br /> <br />3. The southwest corner of the subject lot would be dedicated for <br />drainage and ponding purposes and a 20 foot wide drainage and <br />utility easement would be retained along the rear of the subject <br />lot to serve the subject lot and surrounding properties. <br /> <br />4. The petitioner wishes to construct a swimming pool on the <br />portion of the easement to be vacated. <br /> <br />5. The proposed vacation and subsequent swimming pool installation <br />would not diminish the effectiveness or capacity of the existing <br />drainage and utility easement, or interfere with any future <br />public improvements within the easement area. <br /> <br />BE IT FURTHER RESOLVED, the following described drainage and <br />utility easement is hereby vacated: <br /> <br />That part of the utility, drainage, pondage and flowage <br />easement on Lot 7, Block 1, Oakwood Ponds. according to the <br />plat on file in the office of the County Recorder, Ramsey <br />County, Minnesota, lying northerly of a line 20.00 feet <br />northerly of as measured at right angles to and parallel with <br />the southerly lines of said Lot 7. <br /> <br />, Adopted this 14th day of February, 1989. <br /> <br />~A <br /> <br />ATTEST: <br /> <br />;~ <br /> <br />:, Finance Director I City <br /> <br />I <br /> <br />\. -'.'.'
