<br />,II <br /> <br />RESOLUTION No. <br />06-046 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLU ON MAKING FINDINGS OF FACT AND APPRovAL OF A PRELIMINARY PLAT. <br /> <br />WHERE ,an application has been made by the City of New Brighton to be considered for a <br />Prelim' ary Plat and right-of-way vacation by the Planning Commission. <br /> <br /> <br />, the procedural history of the application is as follows: <br /> <br />5. <br /> <br />application for a Preliminary Plat was received by Pioneer Engineering on behalf of <br />e City on April 28, 2006. <br /> <br />ublic hearing notices for the preliminary plat and right-of-way vacation were published <br />. the New Brighton Bulletin on May 3, 2006. <br />ublic hearing notification was distributed to all property owners within 600' of the <br />ubj ect property. <br />e Planning Commission, pursuant to published and mailed notices, held on a public <br />earing on May 16,2006. <br />he Planning Commission recommended approval to the City Council for the <br />reliminary Plat on May 16, 2006. <br />he City Council reviewed the request on May 23,2006. <br /> <br />1. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />6. <br /> <br /> <br />, the City Council makes the following Findings of Fact in respect to PL2006-001 and <br />-002: <br />The property is zoned 1-2, Heavy Industrial. <br />The property is approximately 490,574 sq. ft. or 11.3 acres in area. <br />The Planning Commission held a public hearing on the preliminary plat and right- <br />of-way vacation on May 16, 2006 and all persons were given the opportunity to be <br />heard. <br />Section 26-31 of the City Code provides regulations concerning preliminary plats <br />and specifies the following requirements: <br />The Planning Commission shall have the preliminary plat on its agenda at its next <br />regular meeting following referral. <br />The Planning Commission shall report to the City Council on or before the second <br />regular meeting of the Planning Commission following acceptance for filing <br />unless a delay is requested in writing by the applicant prior to action by the <br />Planning Commission.
