CONSIDERA TION OF APPROVAL TO AUTHORIZE CREATION OF A <br />FULL TIME AQUATICS COORDINATOR POSITION TO ADMINISTER <br />THE JOINT NEW BRIGHTON/ST. ANTHONY AQUATICS PROGRAM <br />AT A 2001 COST OF $37,600.00. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Public Hearing - None <br /> <br />Council Business <br /> <br />City Manager Matthew Fulton presented the 1999 Annual Financial and Management <br />Reports. The Financial Report is prepared by the Finance Department and audited by an <br />independent certified public accountant. The Management Report is authored by the <br />auditor. The Financial Report received an unqualified opinion which is the most desirable <br />opinion an auditor may make. <br /> <br />Motion by Hoffman, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION ACCEPTING THE 1999 ANNUAL FINANCIAL <br />AND MANAGEMENT REPORTS. <br /> <br />5 Ayes. 0 Nayes, Motion Carried. <br /> <br />City Planner Cary Teague presented a 12.25 ft. sideyard setback variance for 1706 18th <br />Ave. NW to construct a 14 x 30 ft. addition onto an existing garage. Applicant, Mike <br />Prebonich, originally wanted to construct a detached garage in the rear yard which met <br />Code requirements, however, neighbors raised objection and asked Prebonich to consider <br />alternatives. City Code requires a 15 ft. side street yard setback for all structures <br />constructed prior to 1981. Upon Council suggestion, the neighbors and Prebonich went to <br />Ramsey County Dispute Resolution to discuss the matter. During mediation, it was <br />decided that a request for a variance is a preferred alternative than constructing a <br />detached garage. <br /> <br />In considering a variance, the City must make the finding of an undue hardship and unique <br />circumstance. Prebonich feels the hardship is caused by the need for additional storage <br />and neighbor dislike of a detached structure. Teague had difficulty determining the <br />hardship criteria satisfied given the Code allows a 600 sq. ft. detached storage building, <br />and an addition to the existing garage could be constructed to meet required setbacks. It is <br />difficult to find this property unique, and approving the variance may establish precedent. <br /> <br />Staff researched City files to determine if a precedent has been set for this type of request. <br />A number of variances had been granted, and the most similar was a 2.75 ft. variance from <br />the street right-of-way.
