<br />.- <br /> <br />/', <br /> <br />RESOLUTION NO. 89-141 <br /> <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />AGREEMENT WITH THE NATIONAL GUARD FOR FUNDING AND REIMBURSEMENT <br />OF ARCHITECTURAL SERVICES <br /> <br />WHEREAS, on September 26, 1989, the City council <br />approved a resolution of interest in participating in the design <br />and construction of a new National Guard Armory/Community Center <br />facility; and <br /> <br />WHEREAS, the Department of Military Affairs cannot <br />provide funds for the preliminary design work until the City has <br />conveyed title to the site; and <br /> <br />WHEREAS, the preliminary design phase is defined by the <br />Department of Military Affairs as 35% of the total design work; <br />and <br /> <br />WHEREAS, the City has not secured a site, but has <br />determined the need to proceed with the preliminary design phase <br />of the project; and <br /> <br />WHEREAS, to better facilitate the cooperative prelimi- <br />nary design effort between the Guard and the City, it is <br />necessary for the City to enter into a funding and reimbursement <br />agreement with the Guard. <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT: <br /> <br />1. The City Council hereby authorizes the City Manager to <br />negotiate an agreement with the National Guard to provide a <br />funding and reimbursement agreement for architectural <br />services for the preliminary design work. <br /> <br />2. The City will bear the initial responsibility for archi- <br />tectural fees rendered in connection with the preliminary <br />design phase subject to the following limitations: <br /> <br />a. if a site is selected within the City of New Brighton <br />by June 1, 1990, the Minnesota State Armory Building <br />Commission shall utilize its best efforts to secure <br />federal funding to reimburse the City for such costs. <br /> <br />b. if a site is subsequently selected out of the City, the <br />Minnesota State Armory Building Commission shall <br />reimburse the City for the non-site specific archi- <br />tectural costs. <br /> <br />R~ <br />~m.~ <br /> <br />David M.
