<br />-. <br /> <br />-} <br /> <br />~" <br /> <br />RESOLUTION NO. 89--1.2lL. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-276 <br />(2951-2971 16th Street NW). <br /> <br />WHEREAS, an application for a variance has been made by Warren <br />Raiche; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New <br />Brighton on September 1, 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on September 19, 1989, and all <br />persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council considered the application for VN -276 on <br />September 26, 1989. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the <br />following Findings of Fact in respect to VN-276: <br /> <br />1. The property is zoned R-1, Single Family Residential. <br /> <br />2. The required lot width in an R-1 district is 75 feet. <br /> <br />3. The proposed minor subdivision would create a 64.77 foot <br />wide lot (Parcel B) and an 85 foot wide lot (Parcel A). <br /> <br />4. The applicant is requesting a 10.23 foot lot width variance <br />for Parcel B. <br /> <br />5. City records indicate the house and attached garage located <br />on Parcel A was remodeled in 1955, therefore, the structure <br />was constructed sometime prior to 1955. <br /> <br />6. The attached garage located on Parcel A was constructed <br />four feet into Parcel B. <br /> <br />7. The applicant is requesting the minor subdivision and 10.23 <br />foot lot width variance to eliminate the existing encroachment <br />problem and bring the subject attached garage into <br />compliance with the R-1 district setback requirements. <br /> <br />8. The applicant has demonstrated unique and unusual <br />circumstances and undue hardship for the variance request. <br /> <br />9. The subject lot exceeds 10,000 square feet in area. <br /> <br />BE IT FURTHER RESOLVED, the application VN-276 is hereby <br />approved subject to the following condition: <br /> <br />1.
