<br />., <br /> <br />-~ I <br /> <br />,.. <br /> <br />RESOLUTION NO. 89- ~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE <br />PERMIT APPLICATION SP-158. <br /> <br />WHEREAS, an application for a special use permit has been made by <br />the applicant, Tony Mezzenga. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a Special Use Permit, SP-158, was filed <br />with the City of New Brighton on June 30, 1989. <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on July 18, 1989, and all persons <br />present at the hearing were given an opportunity to be heard. <br />3. The City Council considered an application for special use permit <br />(SP-158) on July 25, 1989. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to SP-158: <br /> <br />1. The subject site is zoned R-1, Single Family Residential. <br />2. Moving a single family home onto a lot in an R-1 district requires <br />special use permit approval. <br />3. The proposed single family home would comply with the require- <br />ments of the Uniform Building Code prior to being occupied. <br />4. The proposed single family home would comply with the R-1 <br />district setbacks and FAR. <br />5 . The proposed single family home would replace a chicken coop <br />and boats which presently occupy the site. <br />6. The establishment, maintenance or operations of the special use <br />will not be detrimental to or endanger the public health, safety, <br />morals, comfort or general welfare. <br />7. The special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />8. The establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding <br />property for uses permitted in the district. <br />9. Adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />10. The special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, that the application for SP-158 is <br />and hereby approved subject to the following conditions: <br /> <br />1. Conformance and adherence to all standards for special use <br />permits as pertains in Section 8-110 and 8-130 of the New <br />Brighton Building Code. <br />2. A driveway turnaround be provided alongside the proposed <br />driveway to avoid having vehicles back onto County Road H. <br />3. A grading plan be approved by the City Engineer. <br />4.
