FEE AGREEMENT This ,Fee Agreement (Agreement) is entered into by and between the City of New Brighton, a Minnesota municipal corporation (City), and LeFevere, Lefler, Kennedy, 0 I Brien & Drawz, a Professional Association (LeFevere-Lefler). The City and LeFevere-Lefler agree that the fees and expenses recovered through the "Application for Fees and Expenses Pursuant to the Equal Access to Justice Act" in the lawsuit entitled The City of New Brighton v. The Uni ted States of America, et al. (Court F i Ie No. 3 -84 Civil 1110) should be apportioned as follows: The City shall be reimbursed for all legal fees and expenses determined by Judge Renner to be recoverable under EAJA. The City shall be reimbursed at the rates it paid to LeFevere-Lefler. The balance of the BAJA award, if any, shall be pa id to LeFevere- Lefler for legal services rendered to the City. In witness whereof, the parties have duly executed this Fee Agreement on the date indicated adjacent to each signature.
