<br />Page 7 - May 23, 2006 New Brighton Council Minutes <br /> <br />amendment authorizing food preparation by a third party. <br /> <br /> <br />lotion by Council Member Hoffman, seconded by Council Member Burg to <br />aive the reading and adopt the attached resolntion granting a Special Use Permit <br />subject to the following conditions: <br />1. The proper business license is obtained from the City Sanitarian. <br />2. The applicants submit the required Special Use Permit processing fee of $200. <br /> <br />5 Ayes - 0 Nays, Motion Carried <br /> <br />7. City of New Brighton (p12006-001, va2006-002), 778 1st street NW & <br />Outlot C, Brighton Corpomte Park III, preliminary plat and right -of- <br />way vacation in order to create three lots on one block to be known as <br />Brighton Corporate Park VII. <br />Report No. 06-120. Resolution No. 06-046. <br /> <br />The City Planner-Janice Guncllach gave background information related to the <br />E'.'" quest; it was stated this project would facilitate a land swap with Bell Pole, a sale <br />f the center lot to Ryan Companies, for the future construction of the carrier <br />ex (in conjrmction with the post office relocation), and the sale of the remaining <br />lot to Dalco Companies. <br />Cormcil member Doffmg questioned whether there was any lmown contamination <br />on the land . <br />Mr. Fernelius stated that the City is currently working with Barr Engineering in <br />testing the area, and all results are not known at this time. <br />COlll1cil Member Doffmg requested adding a condition to the resolution stating that <br />the land would be free of any contamination before we would acquire it. <br />Mr. Fernelius replied at this time the council is asked to approve the platting of the <br />parcels, not the land swap, the City Attorney agreed.. <br />Council Member Doffmg requested the condition relating to the environmental <br />issue be included in the resolution. <br /> <br />Motion by Council Member Doffing, seconded by Council Member Hoffman to <br />Waive the reading and adopt the attached resolution granting Preliminary Plat <br />approval subject to the following conditions: <br />1_ 1. A resolution vacating the necessary right-of-way (V A2006-002) is formally <br />adopted in accordance with the final plat. <br />2. Vacation and dedication of the necessary drainage and utility easement, as <br />depicted on the preliminary plat and determined necessary by the Director of <br />Public Works. <br />3. The City reach an agreement acceptable in the land transfer <br /> <br />7.
