<br />,,, <br /> <br />ii <br />'i <br /> <br />... <br />, <br /> <br />RESOLUTION NO. 88-126 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A CERTAIN <br />SECTION OF HIGHCREST ROAD. <br /> <br />WHEREAS, the City Council has been petitioned to vacate the road right- <br />of-way north of Foss Road, south of the Soo Line Railroad right-of-way, and <br />. west of the Lakeside Mobile Home Park. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That the two adjacent property owners requested the vacation of the <br />above described street by their petition of October 9, 1988. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on October 18, 1988 and all persons present at <br />the hearing were given an opportunity to be heard. <br /> <br />3. On October 25, 1988, the City Council reviewed the application for <br />street vacation. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to the proposed vacation: <br /> <br />1. The street is not improved. <br /> <br />2. The street is not maintained. <br /> <br />3. There are no public utilities located within the street. <br /> <br />4. The street serves no public purpose. <br /> <br />5. All adjacent property owners have requested the vacation. <br /> <br />BE IT FURTHER RESOLVED, that the following described street is and <br />hereby vacated: <br /> <br />The west 33 feet of the Highcrest Road right-of-way, adjacent to Block <br />A, Mounds View Acres, 2nd Addition. <br /> <br />CONDITIONED ON: <br /> <br />1. The approval of LP-234. <br />2. The approval of SP-153. <br /> <br />3.
