<br />'\, <br /> <br />~ <br /> <br />-" <br /> <br />RESOLUTION NO. 87--144 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING SPECIAL USE PERMIT APPLICATION <br />SP-146. <br /> <br />WHEREAS, an application for a special use permit has been made by the <br />applicant, Rick Longnecker. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. That an application for a Special Use Permit, SP-146, was filed with <br />the City of New Brighton on October 30, 1987. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on November 17, 1987, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. An application for a Special Use Permit SP-146 was reviewed by the <br />City Council on December 22, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes <br />the following Findings of Fact in respect to SP-146: <br /> <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. Moving a single family home onto a lot in an R-1 district requires <br />special use permit approval. <br />3. The proposed single family home would comply with all R-1 district <br />setback and FAR requirements. <br />4. The proposed single family home would comply with the requirements <br />of the Uniform Building Code prior to being occupied. <br />5. Allowing the single family home to be moved onto the subject lot <br />would cause the existing exterior storage of trucks, tractors, and <br />heavy machinery on the subject lot to be eliminated. <br />6. The establishment, maintenance or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, <br />comfort or general welfare. <br />7. The special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />8. The establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for <br />uses permitted in the district. <br />9. Adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />10. The special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, that the application for SP-146 is and hereby <br />approved subject to the following conditions: <br /> <br />1. Approval of PL-165. <br />2. Conformance and adherence to all standards for special use permits <br />as pertains in Section 8-110 and 8-130 of the New Brighton Building <br />Code. <br />3. The exterior storage of trucks, tractors and heavy machinery on the <br />subject lot be eliminated. <br />4.
