<br />*- <br /> <br />'. <br /> <br />" <br /> <br />~.. <br /> <br />RESOLUTION NO. 87--1.2..6.-. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-261. <br /> <br />WHEREAS, an application for a has been made by James Stuart. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for was filed with the City of New Brighton on <br />October 30, 1987. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on November 17, 1987, and all persons present <br />at the hearing were given an opportunity to be heard. <br /> <br />3. An application for a variance was reviewed by the City Council on <br />November 24, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to VN-261: <br /> <br />1. The subject property is zoned B-3, General Business. <br />2. The required street yard setback for buildings in the <br />B-3 district is 30 feet. <br />3. The existing building was granted a variance on September 26, 1972, <br />allowing a setback of 20 feet from Highway 88. The existing <br />building was subsequently constructed 13 feet from the Highway 88 <br />ROW. <br />4. On July 28, 1987, the City Council granted a 17 foot variance to <br />allow the construction of a solarium addition 13 feet from the <br />Highway 88 ROW. <br />5. The subject site is irregular in shape and bounded by public streets <br />on three sides. <br />6. The resulting 30 foot setback requirement on the three street sides <br />leaves limited building area. <br />7. The applicant is requesting a 15 foot setback variance to construct <br />a storage addition and dumpster enclosure 15 feet from the Long Lake <br />Road ROW. <br />8. The existing dumpster enclosure is setback 8 feet from the Long Lake <br />Road ROW. <br />9. The removal of the existing dumpster enclosure and the construction <br />of the proposed addition would improve the line of sight along the <br />County Road D curve onto Long Lake Road, and from the subject site <br />to said intersection. <br />10. The applicant has demonstrated a unique and unusual circumstance and <br />an undue hardship. <br /> <br />BE IT FURTHER RESOLVED, the application is approved subject to the <br />following conditions: <br /> <br />1.
