<br />" <br />i <br />I <br /> <br />~ <br /> <br />~ <br /> <br />~ <br /> <br />RESOLUTION NO. 87-JJiL- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />'" RESOLUTION GRANTING THE MENGELKOCH COMPANY AN OFFENSIVE TRADES LICENSE AND <br />AFFIXING CERTAIN CONDITIONS OF OPERATION. <br /> <br />WHEREAS, the City of New Brighton is responsible for the general safety, <br />health, welfare and well-being of its residents and has established codes to <br />aid in carrying out this responsibility; and <br /> <br />WHEREAS, City Code Chapter 24 entitled Sewer Department Regulations and <br />Chapter 15, Article VII, entitled Offensive, Dangerous Trades, and <br />Metropolitan Sewer Board Rules and Regulations for the Metropolitan Disposal <br />System and the Minnesota Pollution Control Agency Regulations all apply to <br />the operation of the Menge1koch Company as a rendering business; and <br /> <br />WHEREAS, the City is aware and has been informed that certain <br />deficiencies in the operation of the Mengelkoch Company have occurred in the <br />past with respect to these codes, rules, regulations and standards; and <br /> <br />WHEREAS, the deficiencies which previously existed in regard to disposal <br />of sewage have, in the past, affected the safety, health, welfare and well- <br />being of the City's residents in that such deficiencies cause plugging of the <br />sanitary sewer and lift station, interference with sanitary sewer service to <br />others, dumping of raw sewage on the open ground, and emission of offensive <br />odors in the neighborhood; and <br /> <br />WHEREAS, on February 3, 1987, a stack emission test, in conformance with <br />American Society for Testing Materials Method (ASTH) D-1397-57, was performed <br />on the emission from the stack of the Mengelkoch Company plant facilities at <br />119 - 14th Street NE and such test indicated an average odor level of 28.0 <br />odor units per cubic foot, which is below the limit of 150 odor units allowed <br />by APC-9. Further, that the test indicated a total emission rate of 591,300 <br />odor units per minute which is within the limit of one million odor units per <br />minute allowed by APC-9; and <br /> <br />WHEREAS, a second emission test was performed on July 24, 1987, which <br />indicated an average odor level of 30.0 odor units per cubic foot and a total <br />emission rate of 541,100 odor units per minute. These figures are less than <br />the limit of 150 odor units per minute allowed and less than one million odor <br />units per minute by APC-9; and <br /> <br />NOW THEREFORE BE IT RESOLVED, that the Offensive Trades License of <br />the Menge1koch Company for the premises at 119 - 14th Street NE be granted <br />under the following conditions: <br /> <br />1. All doors and windows shall be kept closed during periods of <br />operation so that all rendering plant air will be processed through <br />a scrubber, except during periods of loading and unloading when <br />loading doors may be open but these periods shall be kept to a <br />minimum. <br /> <br />2. The Menge1koch Company shall continue to perform all obligations <br />required of it by its agreement with the City of New Brighton dated <br />January 25, 1977, and as amended by a subsequent agreement dated <br />December 23, 1978 <br /> <br />3. That any plugging or impairment of the operation of the City sewer <br />system with grease will be considered prime facia evidence that <br />Section 24-8 of the City Code, Section 15-147 of the City Code, <br />Article V, Section 5-4A of the Rules and Regulations for the <br />Metropolitan Sewer Disposal System have been and are being violated <br />and that the right of the rendering plant to use the City sewer <br />system is thereby immediately suspended. <br /> <br />The amount of grease discharged into the City sewer system shall be <br />100 mg. per liter or less. If the City sanitary sewer system or <br />lift station wet well becomes plugged as a result of the operations <br />at the rendering plants, the cost of cleaning shall be paid by the <br />rendering plants making use of that part of the sewer system that <br />has become plugged. <br />
