<br />~ .~-' tit <br /> <br />. <br /> <br />RESOLUTION NO. 87- 110 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRELIMINARY PLAT PL-164. <br /> <br />WHEREAS, an application for preliminary plat approval has been made by <br />CBA Residential Development, Ltd.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for preliminary plat was filed with the City of New <br />Brighton on october 2, 1987. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on October 20, 1987, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. An application for preliminary plat PL-164 was reviewed by the City <br />Council on October 27, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to PL-164: <br /> <br />BE <br />subject <br />1. <br />2. <br /> <br />1. <br /> <br />The City's Comprehensive Plan designates the subject site for Medium <br />Density Residential. <br />The subject site is zoned R-3B, Multiple Family Residential. <br />The property is presently vacant. <br />The preliminary plat satisfies the subdivision regulations contained <br />in Chapter 26 of the City Code; complies with the lot standards of <br />the R-3B district, and is consistent with the City's Comprehensive <br />Plan. <br />The subject site would be adequately served by public streets and <br />public utilities. <br /> <br />2. <br />3. <br />4. <br /> <br />5. <br /> <br />3. <br />4. <br /> <br />IT FURTHER RESOLVED, the application for PL-164 is hereby approved <br />to the following conditions: <br />Approval of LP-218 and VN-260. <br />All final grading, drainage and utilities be subject to review and <br />approval by the City Engineer. <br />Permit approval by the Rice Creek Watershed District. <br />Realign the existing 40 foot wide drainage easement on proposed Lot <br />2 to avoid the proposed duplex unit. <br />Realign existing 10 foot wide drainage easement on proposed Lot 3 to <br />accommodate the proposed storm sewer pipe and avoid the proposed <br />townhouse building. <br />Indicate the location of the existing 12 foot wide sanitary sewer <br />easement located between proposed Lots 3 and 4 on the final plat. <br />Indicate utility services and hookups to all proposed buildings on <br />final utility and grading plan. <br />Provide the proposed legal description and subdivision name on the <br />final plat. <br /> <br />5. <br /> <br />6. <br /> <br />7. <br /> <br />8. <br /> <br />Adopted this 27th day of October, 1987. <br /> <br />ATTEST: <br /> <br />~. <br /> <br />// <br />Robert Benke~Mayor <br /> <br />\\'\A1-.IJo/\\~/ <br />Margare~ Egan, <br />Finance Director/City Clerk <br /> <br /> <br />(SEAL) <br />
