<br />" <br /> <br />_0 <br /> <br />RESOLUTION NO. 87~9 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, <br />VN-257. <br /> <br />WHEREAS, an application for a variance has been made by <br />James Stuart. <br /> <br />WHEREAS, the procedural history of the application is as <br />follows: <br /> <br />1. That an application for VN-257 was filed with the City <br />of New Brighton on July 6, 1987. <br />2. The Planning Commission pursuant to published and <br />mailed notices, held a public hearing on July 21, 1987, <br />and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. The application for a variance was reviewed by the City <br />Council on July 28, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the fOllowing Findings of Fact in respect to <br />VN-257: <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the <br />following Findings of Fact in respect to VN-257: <br /> <br />1. The subject property is zoned B-3, General Business. <br />2. The required street yard setback for buildings in the <br />B-3 district is 30 feet. <br />3. The exiting building was granted a variance on <br />September 26, 1972, allowing a setback of 20 feet from <br />Highway 88. The existing building was subsequently <br />constructed 13 feet from the Highway 88 ROW. <br />4. The subject site is irregular in shape and bounded by <br />public streets on three sides. <br />5. Highway 88 to the east is a State Highway and <br />consequently maintains a large ROW. The distance from <br />Highway 88 to the subject site is approximately 80 <br />feet. <br />6. The applicant is requesting a street sideyard setback <br />variance of 17 feet to bring the existing building into <br />compliance with City approvals and allow the proposed <br />solarium to be located 13 feet from the Highway 88 ROW. <br />7. The variance is no grater than the eXisting setback, <br />would not diminish the green area along Highway 88 or <br />obstruct traffic visibility in the area. <br />8. The applicant has demonstrated unique and unusual <br />circumstances and undue hardship. <br /> <br />BE IT FURTHER RESOLVED, the application is hereby approved <br />subject to the fOllowing conditions: <br /> <br />1.
