.,;

--,>

:,.

RESOLUTION NO. 88-~

STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-267.

WHEREAS. an application for a variance has been made by Brighton Park
Partnership; and

WHEREAS. the procedural history of the application is as follows:

1. An application for a variance was filed with the City of New
Brighton on September 2. 1988.
2. The Planning Commission, pursuant to published and mailed notices,
held a public hearing on September 20. 1988. and all persons
present at the hearing were given an opportunity to be heard.
3. The application for VN~267 was reviewed by the City Council on
September 27, 1988.

NOW THEREFORE BE IT RESOLVED, the City Council makes the following
Findings of Fact in respect to VN-267:

1. The property is zoned 1-2, Heavy Industrial.
2. The requ'ired street sideyard setback for an off-street parking lot
in an 1-2 district is 40 feet.
3. The proposed off-street parking lot adjacent to 2nd Street NW would
be setback 16 feet from the 2nd Street NW right-of-way.
4. The applicant is requesting a 24 foot setback variance.
5. The subject off-street parking lot is designed to allow the parking
of vehicles 40 feet from the 2nd Street NW right-of-way if measured
from the most southerly portion of the stall to the right-of-way.
6. The location of parked vehicles 40 feet from the 2nd Street right-
of-way and the provision of boulevard trees and a 3 foot high
land5caped berm would cause the reduced setback to have a minimal
impact on surrounding land uses and 2nd Street NW.
7. The combination of landscaping and berming along the 2nd Street NW
boulevard and the parking of vehicles 40 feet from the 2nd Street
NW right-of-way, meets the intent of the 40 foot setback
requirement by serving to buffer the off-street parking area from
the public right-of-way.
8. The apparent hardship and unique and unusual circumstance is
created by the linear shape of the subject corner lot and the
proposed use of 2nd Street NW as an industrial roadway for
employee, client. and truck traffic generated by the uses within
Brighton Corporate Park.

BE IT FURTHER RESOLVED, the application for VN-267 is hereby approved
conditioned on:

1. Approval of LP-235 and SP-154.
Adopted this 27th day of September. 1988.

ATTEST:

P0~/~'/"":);~
~~e~:Y:
//:k>12-/ ."~;t/~z:(.t:r-./.
Henry Si , City Manager
I
:/

M~

Finance Director/City Clerk

(SEAL)
