<br />~ <br /> <br />.-, <br /> <br />" <br /> <br />i: <br />i ~ <br /> <br />RESOLUTION NO. 88-~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SP-154 (GENERALLY LOCATED <br />EAST OF 5TH AVENUE AND NORTH OF 2ND STREET NW). <br /> <br />WHEREAS, an application for a variance has been made by Brighton Park <br />Partnership; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New <br />Brighton on September 2, 1988. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on September 20, 1988, and all persons <br />present at the hearing were given an opportunity to be heard. <br />3. The application for SP-154 was reviewed by the City Council on <br />September 27, 1988. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to SP-154: <br /> <br />1. Section 6-370 (c) of the New Brighton Zoning Ordinance allows for a <br />maximum of 2 driveways to a single property, unless the City <br />Council approves a special use permit to allow more than 2 drives. <br />2. The subject parcel would contain 3 drives, 2 of which would be used <br />jointly between the subject parcel and the adjacent parcel to the <br />north. <br />3. The subject parcel and the parcel to the north would create a total <br />of 3 drives; one less than allowed by Code. <br />4. The establishment, maintenance or operations of the proposed drives <br />would not be detrimental to or endanger the public health, safety, <br />morals, comfort of general welfare. <br />5. The proposed drives would not be injurious to the use and enjoyment <br />of other property in the immediate vicinity for the purposes <br />already permitted, nor substantially diminish and impair property <br />values within the neighborhood. <br />6. The establishment of the proposed drives would not impede the <br />normal and orderly development and improvement of the surrounding <br />property for uses permitted in the district. <br />7. The proposed drives shall in all other respects conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application for SP-154 is hereby approved, <br />subject to the following ~ondition: <br /> <br />1.
