<br />'I <br />!! <br /> <br />" <br /> <br />RESOLUTION NO. 88- 105 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A <br />NONCONFORMING USE PERMIT NC-86. <br /> <br />WHEREAS, an application for a nonconforming use permit, NC-86, has been <br />made by Long Lake Community Church to permit the construction of a 6,660 <br />square foot church addition on a site with Type IV nonconformities. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a nonconforming use permit, NC-86, was filed with <br />the City of New Brighton on September 2, 1988. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on September 20, 1988, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. The application for NC-86 was reviewed by the City Council on <br />September 27, 1988. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to NC-86: <br /> <br />1. The following Type IV nonconformities exist on the property: <br /> <br /> A. Lack of poured-in-place continuous concrete curbing around all <br /> parking and drive areas. <br /> B. Parking area within side street yard setback area. <br />2. The subj ect site is zoned R-1, Single Family Residential. <br /> <br />3. Section 6-350 (e) of the Zoning Code requires poured-in-place <br />concrete curbing around all parking areas serving institutional or <br />church developments. <br /> <br />4. Section 4-520 (a) of the Zoning Code does not permit off-street <br />parking areas within the side street yard setback in residential <br />districts. <br /> <br />5. The applicant proposes poured-in-place concrete curbing around all <br />parking and drive areas. <br /> <br />6. The app'licant proposes increasing the existing parking lot setback <br />from the side street yard (25th Street NW) from 0 feet to 15 feet. <br /> <br />7. The applicant has done everything practical to eliminate and reduce <br />the existing Type IV nonconformities. <br /> <br />BE IT FURTHER RESOLVED, the application NC-86 is hereby approved subject <br />to the following conditions: <br /> <br />1.
