<br />'If <br /> <br />'-' <br /> <br />'.;., <br /> <br />RESOLUTION NO. 88- 104 <br />- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A SPECIAL <br />USE PERMIT SP-152. <br /> <br />WHEREAS, an application for a special use permit, SP-152, has been made by <br />Long Lake Community Church to allow a church addition and a day care facility <br />in an R-l district. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit, SP-152, was filed with the <br />City of New Brighton on September 2, 1988. <br />2. The Planning Commission, pursuant to published and maned notices, <br />held a public hearing on September 20, 1988, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. The application for SP-152 was reviewed by the City Council on <br />September 27, 1988. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to SP-152: <br /> <br />1. The subject site is zoned, R-l, Single Family Residential. <br />2. A church and a day care are special uses in the R-l district. <br />3. Long Lake Community Church is presently occupying the subject site. <br />4. Any expansion or enlargement to the structure or operation of special <br />use requires the approval of a special use permit. <br />5. A 6,660 square foot addition is proposed for Long Lake Community <br />Church which would be constructed in two phases and includes <br />classl'ooms, day care, a gymnasium, and garage. <br />6. The Long Lake Community Church has over 5,000 square feet of <br />nonresidential building area, over 1 acre of lot area, and over 50 <br />parking stalls, and therefore, according to Section 4-030 (g) of the <br />Zoning Ordinance may operate a licensed day care facility in the <br />church as a special use. <br />7. The proposed church addition and day care facility border Irondale <br />High School and two public streets, thereby not abutting a single <br />family residential lot or dwelling. <br />8. That the establishment, maintenance or operations of the special use <br />will not be detrimental to or endanger the public health, safety, <br />morals, comfort or general welfare. <br />9. That the specia'l use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />10. That the establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding property <br />for uses permitted in the district. <br />11. That adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />12. That the special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application SP-152 is hereby approved <br />subject to the following conditions: <br /> <br />1. Conformance and adherence to all standards for special use permits as <br />pertains in Section 8-110 and 8-130 of the New Brighton Building Code. <br />2.
