!'

.'

Page 2

8. The on-site incineration process would comply with the New Brighton
Zoning Code, Section 8-130 (a), (b), (c), (d), and (e), special use
permit standards, and Section 6-390 (f), (g), (h) and (i) regarding
performance standards in the 1-2 districts.

9. The thermal processor incineration process has been endorsed by the
New Brighton Environmental Quality Commission.

10. A 50 x 80 foot metal structure has been constructed to accommodate
the rotary kiln thermal processor on a temporary basis.

11. The on-site incineration process is scheduled to be completed by
August 1, 1989, and the rotary kiln thermal processor and metal
structure is scheduled to be removed from the site by January 1,
1990.

12. The uses and structures on the site are Type IV nonconformities
which could not be expanded on a permanent basis without first
securing a proper permit therefor. Furthermore, because of its
temporary nature, the proposal has not undergone site plan review to
consider such matters as parking and landscaping. Therefore, this
permit would not be granted but for the facts that the use is to be
on a temporary basis only and that there is a compelling need to
provide for the correction of contaminated soils problems.

BE IT FURTHER RESOLVED, the application for SP-135 is hereby recommended
for approval until January I, 1990, conditioned on:

1. The on-site rotary kiln thermal processor may only be operated
during the time period specified by the Air Emission Facility Permit
approved by the MPCA.

2. The removal from the site of the processor and all related
improvements by January I, 1990, and the restoration of the grade
and rehabilitation of the site to its original condition as soon as
reasonable practicable thereafter.

Adopted this 27th of September, 1988.

ATTEST:

~~~
Margaret Egan, \
, Finance Director/City Clerk
~
Robert Benk ,.
