<br />( . <br /> <br />AGREEMENT <br /> <br />THIS AGREEMENT, <br />-------- <br />c:Zv----/~ " 19 B 8 , <br />/ <br />Minnesota municipal <br /> <br />made <br /> <br />and <br /> <br />entered <br /> <br />into <br /> <br />this <br /> <br />~ <br />! :~y <br /> <br />of <br /> <br />by and between the City of New Brighton, <br /> <br />a <br /> <br />corporation (hereinafter referred to <br /> <br />as <br /> <br />"City") and Gordon and Marion J. Hedlund, individuals residing in <br /> <br />the City of New Brighton, Ramsey County, Minnesota, (hereinafter <br /> <br />collectively referred to as the "Hedlunds"); <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the Hedlunds have initiated suit against the City <br /> <br />by service of a Summons and Complaint, a copy of which is <br /> <br />attached as Attachment One, in which the Hedlunds complain of <br /> <br />various acts of the Ci ty wi th respect to property owned by the <br /> <br />Hedlunds in the Ci ty of New Brighton, that portion of which is <br /> <br />still owned by the Hedlunds which is legally described as Lots 3, <br /> <br />4, 5 and 6, Block 1 and Lots 2, 3, 4 and 5, Block 2, all in Leier <br /> <br />Estates in the City of New Brighton, Ramsey County, Minnesota <br /> <br />(hereinafter referred to as the "Subject Property"); and <br /> <br />WHEREAS, <br /> <br />the City has responded to said Summons and <br /> <br />Complaint by the service of an Answer and Counterclaim in said <br /> <br />suit, a copy of which is attached hereto as Attachment TWO; and <br /> <br />WHEREAS, Plaintiff and Counterclaim Defendant Gordon Hedlund <br /> <br />has applied for approval of a plat and planned residential <br /> <br />development on the Subject Property pursuant to the New Brighton <br /> <br />City Code of Ordinances; and <br />
