<br />~~ <br /> <br />.. <br /> <br />,,~~ <br /> <br />RESOLUTION NO. 88- 51 <br />- <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE PERMIT <br />APPLICATION SP-149. <br /> <br />WHEREAS, an application for a Special Use permit has been made by the <br />applicant, John Robinson. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Special Use permit, SP-149 was filed with the <br />City of New Brighton on April 29, 1988. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on May 17, 1988, and all persons present at <br />the hearing were given an opportunity to be heard. <br />3. An application for Special Use permit SP-149 was reviewed by the <br />City Council on May 24, 1988. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to SP-149: <br /> <br />1. The subject site is zoned R-1, Single Family Residential. <br />2. Moving a single family home onto a lot in an R-1 district requires <br />special use permit approval. <br />3. The proposed single family home would comply with all R-1 district <br />standards regarding setbacks, structure height, and floor area <br />ratio. <br />4. The proposed single family home would comply with the requirements <br />of the Uniform Building Code prior to being occupied. <br />5. The preservation of the existing trees along 5th Avenue NW and Old <br />Highway 8 would provide a buffer between the single family home and <br />vehicles traveling said streets. <br />6. The proposed single family home would obtain access from 7th Street <br />NW. <br />7. The establishment, maintenance or operations of the special use will <br />not be detrimental to or endanger the public health, safety, morals, <br />comfort or general welfare. <br />8. The special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br />9. The establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for <br />uses permitted in the district. <br />10. Adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />11. The special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, the application for SP-149 is hereby approved <br />subject to the following conditions: <br /> <br />1. Conformance and adherence to all standards for special use permits <br />as pertains in Section 8-110 and 8-130 of the New Brighton Building <br />Code. <br />2. Landscape plan to be approved by the City Planner, which maintains <br />as many of the existing trees along 5th Avenue NW and Old Highway 8 <br />as possible. <br />3. Access to subject site be provided from 7th Street NW. <br />
