<br />RESOLUTION NO. 8~-~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF A PORTION OF <br />THE 15TH STREET NW RIGHT OF WAY. (Generally located south of Hidden Oaks Park <br />between Lot 6, Hennum Addition and Lot 12, Innsbruck North 3rd Addition). <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. More than 50% of the property owners petitioned the vacation of the <br />subject right of way on February 8, 1988. <br /> <br />2. The City Council, pursuant to published and mailed notices, held a <br />public hearing on March 8, 1988, and all persons present at the <br />hearing were given an opportunity to be heard; <br /> <br />3. The written comments and analysis of City Staff were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes <br />the following Findings of Fact in respect to the proposed vacation: <br /> <br />1. The subject 15th Street NW right of way abuts Lot 6, Block 1, Hennum <br />Addition, and Lots 11 and 12, Block 1, Innsbruck North - New <br />Brighton Third Addition; <br /> <br />2. A petition to vacate the subject portion of 15th Street NW right of <br />way was received by the City from all abutting property owners. <br /> <br />3. The portion of 15th street NW right of way as described below is <br />unimproved and does not serve a public purpose; <br /> <br />4. There are no utilities within the subject portion of right of way; <br /> <br />5. There appears to be no need for the right of way or easement in <br />terms of future street and utility improvements. <br /> <br />BE IT FURTHER RESOLVED, that the Council hereby vacates the portion of <br />15th Street NW right of way described as follows: <br /> <br />The northwesterly 1/2 of 15th Street NW as platted in Hennum <br />Addition, Ramsey County Minnesota, which lies adjacent to Lot 6, <br />Block 1, of said Hennum Addition. <br /> <br />Adopted this 8th day of March, 1988. <br /> <br />~~ <br /> <br />Robert Benke, Mayor <br /> <br />> ATTEST: <br /> <br />'i )PI <br /> <br /> <br />.' <br /> <br /> <br />Clerk <br /> <br /> <br />Henry S' a, City Manager <br /> <br />(SEAL) <br />
