<br />'.:/' <br /> <br />.... <br /> <br />!r~ <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION NO. 88-18 <br /> <br />RESOLUTION MAKING FINDINGS, <br />CONCLUSIONS AND ORDER IN THE <br />MATTER OF THE APPEAL OF <br />RELOCATION BENEFITS OF <br />A. THOMAS OSWALT <br /> <br />WHEREAS, a claim for relocation benefits pursuant to Minn. ~., <br /> <br />~~117.045 and 117.52 has been filed with the City by Mr. A. Thomas Oswalt for <br /> <br />the taking of his former residence at 1411 Seventh Street Northwest in the <br /> <br />City of New Brighton; and <br /> <br />WHEREAS, said claim has been duly processed in accordance with City <br /> <br />procedures for the determination of entitlement to such benefits under the <br /> <br />regulations of the United States Department of Housing and Urban Development, <br /> <br />24 CFR, Part 42 (1979 regulations) (hereinafter referred to as the <br /> <br />"Regulations"); and <br /> <br />WHEREAS, the initial determination of the responsible department head was <br /> <br />appealed by Mr. Oswalt to the City Manager by oral and written appeal; and <br /> <br />WHEREAS, the City Manager has rendered a decision on the appeal granting <br /> <br />the claim in part and denying it in part, which decision has been appealed to <br /> <br />the City Council; and <br /> <br />WHEREAS, the City Council has considered the appeal by Mr. Oswalt, who <br /> <br />was represented by his attorney, Mr. Bradley Gunn, Esq., at a hearing on <br /> <br />January 26, 1988, which was continued to February 9, 1988; and <br /> <br />WHEREAS, the Council has duly considered the arguments of counsel and all <br /> <br />proceedings, documents, and files submitted in connection with the appeal. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br /> <br />Brighton that the Council hereby adopts the following findings, conclusions, <br /> <br />and order: <br />
