<br />City Planner Cary Teague presented a request for a minor subdivision by Alan Dale and
<br />Don Rodningen to divide an existing vacant parcel located at the southwest corner of
<br />Co, Rd, H and Long Lake Rd, into two lots. Also, the applicant is requesting vacation
<br />of the 14 ft. alley right-of-way along the western property line south of Co, Rd. H. The
<br />first 140 ft, of this alley has been vacated from Sunnyside Ter. The proposed lots meet
<br />all minimum code requirements, However, there has been some question regarding the
<br />parcel's ownership. Dale/Rodningen applied for the application, but the County shows
<br />the taxpayer as Genevieve Haack, Haack is deceased, but her heirs have requested the
<br />subdivision be tabled until the ownership issue is resolved.

<br />Samuelson asked if the driv~way for Parcel B would exit onto Co, Rd. H. Teague said
<br />Ramsey County would need to approve the driveway access, but such access would not
<br />be out of character with the neighborhood,
<br />
<br />Benke asked if action could be taken contingent on resolution of the ownership issue.
<br />City Attorney Charlie LeFevere does not feel the issue could be resolved before the next
<br />Council meeting due to possible court proceedings. Another concern is an impending
<br />sale could potentially bring another party into this complicated case,
<br />
<br />Richard Glassman, 701 4th Ave. Minneapolis, is an attorney representing the estate of
<br />Haack, He believes Haack is the true owner of the property which she purchased from
<br />Dale Tile in 1976,
<br />
<br />Robert Haack, PO Box 4153, Thousand Oaks, California, is Haack's son and estate
<br />executor, He said the estate has continued to pay the taxes, insurance, and maintain the
<br />property since 1976, Haack objects to the minor subdivision and alley vacation request.
<br />
<br />Leonard Bibenski, 2581 17th Ave, NW, is concerned this project will remove many
<br />mature trees bordering his property,
<br />
<br />Don Rodningen, 4301 Victoria St. Minnetonka, is purchasing the parcel from Dale, He
<br />said Dale Tile is the true owner even though Haack has been paying the property taxes,
<br />He understood that Haack deeded back the property to Dale as a settlement for a debt.
<br />He does not intend to remove many trees, and feels the alley vacation should not be an
<br />issue. The purchase agreement is contingent upon resolution, and the closing is
<br />scheduled for August 27.

<br />Because of the situation, Benke feels the Council should heed the advice of staff and City
<br />Attorney and defer action until resolution of the ownership issue, LeFevere would not
<br />recommend deferral until the court action is resolved, but allowing two weeks may give
<br />the parties time to determine the next course of action,
