<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />June 8, 1999 <br /> <br />Page 4 <br /> <br />Council Business. continued <br /> <br />On May 5, a meeting was held with NBLLP, Rice Creek Watershed District (RCWD), <br />DNR, and City staff. RCWD indicated willingness to financially support up to 25 % of <br />the channel dredging costs, but did not offer financial support for the lagoon dredging. <br /> <br />Fulton explained the lagoon was originally constructed to develop additional residential <br />properties in this area. This lagoon directly benefits the adjacent properties and does not <br />serve a as direct benefit to the public waterway system. Staff recognizes the need to deal <br />with the drainage issues, and supports NBLLP desire to go before the RCWD to request <br />a reconsideration of the earlier decision for financial support. <br /> <br />Roger Schilling, NBLLP, said the chamlel area is continually utilized by the public as a <br />public waterway, and much of that activity created the sedimentation resulting from Rice <br />Creek. The NBLLP disagrees with RCWD's contention that the affected properties are <br />responsible for 75 % of dredging costs. He noted the recent Locke Lake dredging <br />project, which is surrounded by private properties, and was financially supported by the <br />RCWD and County. <br /> <br />Rick White, NBLLP, disagrees with RCWD's assertion that dredging of the lagoon <br />provides benefit only to affected properties. He believes the sedimentation problems <br />have worsened, and were created by the flowage of Rice Creek into the lagoon. <br /> <br />Samuelson asked the specifics of developing a special taxing district. Fulton said the <br />impacted properties could be joined within a stonnwater special taxing district, and the <br />dredging costs would be allocated equitably amongst benefitting properties. <br /> <br />Gunderman supports the efforts of the NBLLP. <br /> <br />Fulton will attend the June 23 RCWD meeting to negotiate financing responsibility. <br /> <br />Motion by Samuelson, seconded by Larson, to DIRECT STAFF TO WORK WITH <br />THE RICE CREEK WATERSHED DISTRICT TO ENABLE THE DREDGING <br />OF THE RICE CREEK CHANNEL WAY AND LAGOON FOR THOSE <br />AFFECTED PROPERTIES AND NEGOTIATE THE BEST FINANCING <br />SITUATION POSSIBLE FOR THE AFFECTED PROPERTY OWNERS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Announcements and Updates <br /> <br />The June 10 grand opening of Donatelle Plastics will be recognized by a proclamation. <br /> <br />Mayor Benke PROCLAIMED A SPECIAL COMMENDATION TO MR.
