<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 24, 1999 <br /> <br />Page 3 <br /> <br />Council Business <br /> <br />City Manager Matthew Fulton presented a public hearing request to review an <br />application for On-sale Wine and Beer License at the Bru Haus, 1431A Silver Lk Road. <br />The applicant proposes to sell wine and beer in conjunction with the restaurant with no <br />Sunday sales or exterior public space requested. Concerning the 400 ft. rule, the <br />business is 600 ft. from the Pike Lake School property line of Pike Lake School. <br /> <br />Motion by Hoffman, seconded by Gunderman, to SCHEDULE A PUBLIC HEARING <br />ON JUNE 8, 1999, AT 7:30 P.M. TO CONSIDER THE ON-SALE WIND AND <br />BEER LICENSE APPLICATION OF LYNN BARTON, DBA, THE BRU HAUS. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Planner Cary Teague presented a minor subdivision to divide a lot at 201 5th Ave. <br />SW into two lots. New Brighton Lumber and Freeway Towing reside on the lot, and <br />Freeway wishes to move to the new parcel. Existing site non-conformities need to be <br />addressed, and Freeway Towing would require a special use permit. Both lots access off <br />5th Ave., and Parcel B will also gain access from an ingress/egress easement on Parcel <br />A. Access to the property to the south (contains a billboard) would be via a cross <br />easement over Parcel B. Parcel B is located 500 ft. away from utility connections, and <br />installation of water and sewer hookups are required. As a condition of approval, the <br />site non-conformities and zoning violations would need to be corrected. The Planning <br />Commission and staff recommend approval, subject to the conditions noted. Charles <br />Stark, applicant, verified the non-conformities and storage issues will be resolved. <br /> <br />Motion by Gunderman, seconded by Hoffman, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING PL-251, SUBJECT TO <br />COMPLIANCE WITH THE FOLLOWING CONDITIONS: <br /> <br />1. <br /> <br />THERE SHALL BE A DRIVEWAY MAINTENANCE AGREEMENT <br />ESTABLISHED BETWEEN PARCEL A AND PARCEL B, SUBJECT TO <br />REVIEW AND APPROVAL OF THE CITY ATTORNEY. <br />THERE SHALL BE NO BUILDING ENCROACHMENT INTO THE 30- <br />FOOT INGRESS & EGRESS (DRIVEWAY) EASEMENT ON PARCEL A. <br />NO PARKING SHALL BE ALLOWED WITHIN THE 30-FOOT INGRESS <br />& EGRESS (DRIVEWAY) EASEMENT ON PARCEL A. <br />ALL JUNK, DEBRIS AND CONSTRUCTION MATERIALS SHALL BE <br />REMOVED FROM PROPOSED PARCEL B. <br />PERIMETER CURBING SHALL BE INSTALLED IN THE LOCATIONS <br />WHERE NO CURBING EXISTS ON PARCEL A. <br />AREAS ON PARCEL A UTILIZED FOR OFF-STREET PARKING AND <br />DRIVE-AISLES SHALL BE PAVED WITH A BITUMINOUS SURFACE. <br />GRADING AND DRAINAGE ASSOCIATED WITH THE <br />DEVELOPMENT OF PARCEL B SHALL NOT HAVE ANY NEGATIVE <br />IMPACTS ON ADJACENT PROPERTIES AND SHALL BE SUBJECT TO <br />REVIEW AND APPROVAL OF THE CITY ENGINEER. <br />DEVELOPMENT OF PARCEL B SHALL REQUIRE THE SUBMITTAL <br />OF A UTILITY PLAN SHOWING INDIVIDUAL LOT HOOK UP OF <br />SEWER AND WATER FOR PARCEL B.
