Also, "such findings shall <br />be made by Council after considering the effect of natural barriers, highway <br />thoroughfares, proximity to park areas and other areas of public assembly, the activities <br />conducted in any such church or school, the nature of the license operation and the <br />orientation of an access to the building and property. " <br /> <br />The Police Department noted no objection to granting a waiver of the distance <br />requirement. However, City Code requires a public hearing prior to granting a new <br />liquor license. <br /> <br />Benke believes the public hearing should be held prior to consideration of the distance <br />waiver, and the waiver should be incorporated into the action taken at the hearing. <br /> <br />Applicants David Anton and Tim Gabel said their store would be located 361 ft. from <br />the Church, however, the Eagles Club which sells on-sale liquor is located 381 ft. from <br />that same church. City Attorney Charlie LeFevere verified that distance restrictions <br />relate to both on and off sale liquor licenses, however, the Eagles Club permit may have <br />predated Code restrictions. <br /> <br />Benke suggested that Anton and Gabel speak to the Economic Development Department <br />regarding other possible sites within the City. <br /> <br />Larson asked the number of parking stalls required for this operation. City Planner <br />Cary Teague said a ratio of one stall/200 sq. ft. determines the number of stalls, and this <br />site falls short of that requirement. If the applicants expanded the building, a site plan <br />review is required and parking standards would need to be met. Gabel added that liquor <br />store locations are required to be distanced more than one mile apart. <br /> <br />Motion by Samuelson, seconded by Hoffman, to SCHEDULE A PUBLIC HEARING <br />ON MARCH 23, 1999, AT 7:30 P.M.
