I

I

I

Council Meeting Minutes
January 7, 1999

Page 6

Council Business. continued

Tom Johnson, AAA legal representation, explained that the closing date has been
extended to allow for site plan approval. AAA has some concern with the site's fencing
and maneuverability, but would not increase the size of the terminal.

Ted Kirschner, AAA, explained the planned site improvements. Larson feels relocating
the fueling facility to elsewhere on the site would eliminate the need to back trucks out
after fueling. Kirschner remarked that relocating the fueling facility would diminish the
usefulness of the terminal garage doors. Benke asked if the fueling facility could be
located within the existing parking area. Teague confirmed the site contains more than
the required number of parking stalls. Benke suggested the fueling station be added to
the terminal which would then provide screening of the canopy area from Old Hwy 8.
Kirschner feels this arrangement may be a feasible, and added that the proposed
improvements and landscaping could easily cost $200,000 for a property currently
assessed at $800,000. The landscape plan involves trees of three inch diameter.

Johnson reiterated that AAA does not intend to apply for a site plan during the time
period identified within the ordinance.

Eric Gallet, Bebet legal representation, confirmed that the purchase agreement is
contingent on Council approval of the site plan. Bebet will not seek any other site plan
approvals other than the proposal submitted at this time.

Motion by Larson, seconded by, to WAIVE THE FIRST AND SECOND READINGS
ADOPTING AN ORDINANCE REVISING THE NEW BRIGHTON ZONING
ORDINANCE BY REZONING CERTAIN PROPERTY WITHIN THE CITY OF
NEW BRIGHTON FROM 1-1, LIGHT INDUSTRIAL TO MX, MIXED USE.

5 Ayes - 0 Nayes, Motion Carried.

Announcements and Updates

Benke announced the idea to usher in the Millennium by organizing a Community
Millennium Family Celebration to be held at the Family Service Center on December
31, 1999.
