<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 24, 1998 <br /> <br />Page 6 <br /> <br />Council Business. continl,led <br /> <br />Motion by Gunderman, seconded by Samuelson, to CONTINUE CONSIDERATION <br />OF THE NAME CHANGE AND ADDRESS CORRECTION FOR THE OLD HWY <br />8 CORRIDOR TO THE MARCH 24, 1998, COUNCIL MEETING; AND DIRECT <br />STAFF TO TAKE ACTION ON STRATEGIES FOR PUBLIC NOTIFICATION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried, <br /> <br />Locke presented the release of the Williams Pipeline Company easement and granting <br />authorization to cross City lands and ROW. In January, staff began quiet title process to <br />secure partial release of a blanket easement on the former MacGillis & Gibbs site. This <br />easement prevented the City's ability to provide clear title. In exchange for the release <br />of the broader blanket rights on the east side of the tracks, Williams asked for City <br />cooperation if the pipeline needs to be moved to west. The cleanup process is still under <br />consideration by the MPCA, and remediating the site with the pipeline in place may still <br />be an issue. The easement would cross under the railroad tracks at 1st St. and follow <br />along the west to connect with the existing pipeline. This permits the pipeline under the <br />5th St. cul-de-sac and the encroachment at the water treatment plant. This action is not a <br />formal conunitment, but indicates the City's support to allow the pipeline's usage of the <br />street ROW. From a staff and legal perspective, this is a good solution to the problem, <br /> <br />Gregori thanked staff for their efforts, Locke noted the tremendous work by the <br />attorneys which have been instrumental in resolving this issue, <br /> <br />Motion by Samuelson, seconded by Gunderman, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION TO LIMIT THE WILLIAMS PIPELINE <br />EASEMENT ON BCPIII AND GRANT WILLIAMS AUTHORIZATION TO <br />CROSS CITY LANDS AND RIGHTS OF WAY PER AGREEMENT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Announcements and Updates <br /> <br />Fulton introduced Susan Arntz, the new Assistant to the City Manager. <br /> <br />The Public Utilities Commission has required US West to change area codes based on <br />municipal boundaries. The New Brighton area code will change to "651", however, <br />U. S, West has requested to retain the properties north of the railroad tracks as in the <br />"612" area code.
