This portion of the existing ROW lying east of 5th Ave. served <br />several single family homes and a trucking company. However, the City has acquired <br />the properties along the segment, and the ROW no longer serves a public purpose and is <br />impeding development of the Brighton Corporate Park II development area. <br /> <br />Samuelson confirmed that this ROW segment deadends at 1-35W. <br /> <br />I <br /> <br />There were no comments from the audience. <br /> <br />Motion by Williams, seconded by Larson, to CLOSE THE PUBLIC HEARING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Motion by Larson, seconded by Samuelson, to WAIVE THE READING AND ADOPT <br />THE RESOLUTION V ACA TING THE PORTION OF THE FIRST STREET NW <br />RIGHT OF WAY LOCATED EAST OF THE FIFTH AVENUE NW. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Community Development Director Kevin Locke presented the stipulation agreement by <br />and between the City and MacGillis & Gibbs. In April, Council authorized use of <br />eminent domain to acquire the property for redevelopment purposes. MacGilIis & Gibbs <br />has agreed to the following settlement terms: <br /> <br /> 1. <br /> 2. <br />I 3. <br />4. <br />5. <br />6. <br /> 7. <br /> 8. <br /> <br />Transfer of the property by September 1, 1997. <br />MacGillis & Gibbs will provide deed to property and cooperate to eliminate <br />property tax liens against the property. <br />MacGillis & Gibbs will provide evidence liens have been satisfied. <br />MacGillis & Gibbs will provide site access for investigation, surveys, etc. <br />MacGillis & Gibbs will join with the City in recording of any plats. <br />MacGillis & Gibbs will discontinue operations and completely shutdown <br />operations consistent with EPA and MPCA regulations. <br />Total consideration of $50,000 will be placed in escrow until property is free of <br />liens.
