Such <br />action would be done with the advice and involvement of our City Attorney. <br /> <br />Samuelson asked if this appeal requires monetary outlay. LeFevere said there would not <br />be monetary outlay, however, there could be monetary risk. The original monetary <br />damages awarded were only 5-6 % of what was requested. Because of this, an adverse <br />decision could result in an award of higher damages. <br /> <br />LeFevere said the judgement involves a $300,000 penalty if a defined number of <br />minority candidates are not hired during a specific timeframe. This is an affirmative <br />action effort to locate minority candidates and make employment offers for internships, <br />cadets, or community service officers. This will increase the number of minorities in <br />the pipeline and result in higher numbers of entry level sworn police officers. However, <br />the cities do not know how many employment offers are needed to avoid the penalty or <br />satisfy the judge. Candidates are sought out because of race, and this race preference <br />hiring is justified constitutionally because it is necessary to remedy past discrimination. <br />However, the LICIT could be placed into a reverse discrimination situation because of <br />the order. Benke asked if cities should seek legislative changes.
