<br />RESOLUTION NO. <br />06~055 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLU ON MAKING FINDINGS OF FACT AND ApPROVAL OF A SITE PLAN REVIEW AND SPECIAL <br />USE P ITS AND DENIAL OF VARIANCES. <br /> <br />WHERE <br />Revie <br />Varian <br />numbe <br /> <br /> <br />, an application has been made by Aleksey Zaytsev to be considered for a Site Plan <br />Special Use Permit for automotive repair, Special Use Permit for automotive sales, <br />to required building setback, and Variances to required parking setbacks and required <br />of parking stalls. <br /> <br />WHERE , the procedural history of the application is as follows: <br /> <br />1. application for a Site Plan Review, Special Use Permit and Variances was approved <br />y the City Council on October 28, 2003 but was allowed to expire. <br /> <br />2. he Planning Commission considered a similar request and held a public hearing on May <br />6, 2006 to consider a Site Plan review, two Special Use Permits, and associated <br />ariances. <br /> <br />3. e Planning Commission tabled the May public hearing to allow the applicant to <br />onsider a revised plan. <br /> <br />4. n June 6, 2006 the City extended the 60-day review period to August 19, 2006 to allow <br />onsideration of a revised plan. <br /> <br />S. he Planning Commission re-opened the public hearing and considered a revised plan on <br />une 20, 2006. <br /> <br />6. n June 20, 2006 the Planning Commission recommended conditional approval to the <br />ity Council for the Site Plan review, Special Use Permit for automotive repair, and <br />pecial Use Permit for automotive sales. <br /> <br />7. n June 20, 2006 the Planning Commission recommended denial of the requested <br />ariances. <br />8. he City Council reviewed the request on June 27, 2006. <br /> <br /> <br />WHERE , the Planning Commission and Council make the following Findings of Fact in respect <br />to SP2 06-008, LP2006-003, and VN2006~001: <br />1 The property is currently vacant land. <br />2 The property is zoned 1-1, Light Industrial. <br />3 The Comprehensive Plan designation for the property is Industrial. <br />4 The property is approximately 9,642 sq. ft. in area. <br />S The Planning Commission and Council recommended approval for a Site Plan Review. <br />6 The Planning Commission held a public hearing for a Special Use Permit to consider an <br />automotive repair use and an automotive sales use on May 16,2006, continued to June <br />20,2006, and all persons were given the opportunity to be heard. <br /> <br />I:\COUN L\REPORTS\2006\Community Development\06-27 -2006\SP2006-008, VN2006-001, LP2006-003 (Zaytsev) RESOLUTION. doc <br />1 <br />
