A strict enforcement of the setback <br />requirement would cause the applicant an undue hardship. The Planning Commission <br />recommends approval. <br /> <br />Larson asked the status of the large evergreen tree on the driveway's south side. Mattila <br />said the architect recommends removal of the tree, but the contractor feels it should <br />remain. The City Forester feels planting of more trees will reduce the curve's site lines <br />and create a safety concern, Mattila concurs. The Planning Commission recommends <br />the architect, contractor, and staff discuss this issue. <br /> <br />Gunderman asked why the grading plan is subject to City Engineer approval. Mattila <br />said typically site plans require City Engineer approval and some require Rice Creek <br />Watershed District approval. A performance bond is required for all site plans. <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTIONS APPROVING SP.192 AND VN-305, SUBJECT TO <br />CONDITIONS; AND APPROVAL OF LP-312, SUBJECT TO THE FOLLOWING <br />CONDITIONS: <br />1. APPROVAL OF SP-I92 AND VN-305. <br />2. CITY ENGINEER APPROVAL OF GRADING AND DRAINAGE PLAN. <br />3. PROVISION OF A LETTER OF CREDIT OR PERFORMANCE BOND <br />EQUAL TO 100% OF COST TO INSTALL PAVING AND CURBING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Community Development Director Kevin Locke presented the contract for private <br />redevelopment with Industrial Equities Group (lEG) for Brighton Corporate Park II <br />(BCP II) TIF#15. The agreement terms include: <br /> <br />I. Four buildings constructed over the next few years for a total of 178,000 sq. ft. <br />2. Initial building completion of a 64,000 sq. ft. facility by end of 1996. <br />3. Initial building will have a brick and glass exterior on three sides. <br />4. Minimum market value of all buildings will be at least $30/sq. ft. <br />5. Purchase price for the initial building site will be $150,000, the purchase price <br />for the remaining site will be $1.50/sq. ft. <br />6. Any survey, environmental review, soil borings, platting actions and all other <br />costs will be IEG responsibility. <br />7. The developer will rough grade the site. <br />8.
