<br />. <br /> <br />. <br /> <br />. <br /> <br />MINUTES <br />New Brighton Economic Development Commission <br />Regular Meeting - June 13, 2006 <br />7:00 a.m. <br /> <br />MembersILiaisons Present: Gina Bauman, Gene Delaune, Dennis Flahave, Linda Harmon, <br />Lisa Harreld, John Kaufhold, Steve Larson, Mark Nelson, Jim Sculthorp, and Gary Stang. <br /> <br />MembersILiaisons Absent: Bob Benke, and Bruce Nustad. <br /> <br />Staff Present: Matt Fulton, Grant Femelius, and Jennifer Lavandowska. <br /> <br />Call to Order <br />Mark Nelson called the meeting to order at 7:00 a.m. <br /> <br />Approval of Minutes <br />The minutes of the May 9, 2006 meeting were presented for approval. All approved. <br /> <br />Northwest Quadrant Report <br />Property Acquisitions <br /> <br />Post Office <br />Femelius reported that the Post Office owner and the City are apart on the price for the property <br />by $400,000.00 to $500,000.00. The owner is not willing to recognize that the Post Office <br />Service has a lease hold interest that carves out a portion of the price for the property. The <br />owner has retained an attomey in the last two months, Tom Radio, who also represented <br />Midwest Asphalt. While Radio acknowledges that the Post Office Service has a leasehold <br />interest, he has come back to the City stating that the owner wants more money for the property. <br />At the May 23rd Council meeting an eminent domain resolution went before the Council and was <br />passed 3 to 2. <br /> <br />Kaufhold suggested that the owner should not be able to state that the property is worth a certain <br />dollar amount to the City and then tell the county that it's worth less and pay taxes at a lower <br />dollar amount. Femelius replied that the property has been assessed and the County set's its tax <br />based on that assessment. Kaufhold inquired if the City could force the owner to clean up the <br />contamination on his property. Femelius replied that the City can not compel him to clean up the <br />property and the dump is not under the building, but is under the parking lot, which is City <br />property. <br /> <br />Delaune inquired if the City has selected a deadline for when it will apply the eminent domain. <br />Femelius replied that the condemnation papers have been filed. The proposed date for <br />everything to be complete, including any appeals, will be November 2008. Sculthorp asked if <br />there was a timeline for the project and how will this delay affect it. Femelius replied that it will <br />cause a delay in the grading; however the clean up of the dump can be done around the building. <br /> <br />Page 1 of5 <br />
