..

"

RESOLUTION NO. 87-~

STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON

RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION FOR A NON-
CONFORMING USE PERMIT NC-76.

WHEREAS, an application for a non-conforming use permit, NC-76, has been
made by Independent School District No. 621 (Pike Lake Elementary School) to
permit the construction of a 11,505 square foot school addition on a site
with Type IV non-conformities.

WHEREAS, the procedural history of the application is as follows:

1. An application for a non-conforming use permit, NC-76, was filed -
with the City of New Brighton on April 3, 1987.

2. The Planning Commission, pursuant to published and mailed notices,
held a public hearing on April 21, 1987, and all persons present at
the hearing were given an opportunity to be heard.

3. The City Council reviewed the non-conforming use permit application
on May 12, 1987.

NOW THEREFORE BE IT RESOLVED, the City Council makes the following
Findings of Fact in respect to NC-76:

1. The following Type IV non-conformities exist on the property:

A. Lack of poured-in-place continuous concrete curbing along the
north and west side of existing parking area.

B. Parking area within front yard setback area.

2. The subject site is zoned R-1, Single Family Residential.

3. Section 6-350 (e) of the Zoning Code requires poured-in-place
concrete curbing around all parking areas serving institutional
developments.

4. Section 4-520 (a) of the Zoning Code does not permit off-street
parking areas within the front yard setback in residential districts.

5. With the provision of concrete curbing around existing parking
areas, the applicant would have done everything practical to
eliminate and reduce the existing Type IV non-conformities.

BE IT FURTHER RESOLVED, the application NC-76 is hereby approved subject
to the following conditions:

1. Provision of poured-in-place concrete curbing along the north and
west side of the existing parking area.

Adopted this 12th day of May 1987.

~

ATTEST:

M~~

Finance Director/City Clerk

(SEAL)

EM/vi
