<br />:r <br /> <br />RESOLUTION NO. 87-~ <br /> <br />~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE PERMIT <br />APPLICATION SP-137. <br /> <br />WHEREAS, an application for a special use permit has been made by the <br />Philadelphia Church. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. That an application for a Special Use Permit, SP-137, was filed with <br />the city of New Brighton on April 3, 1987. <br /> <br />2. The City Council, pursuant to published and mailed notices, held a <br />public hearing on April 21, 1987, and all persons present at the <br />hearing were given an opportunity to be heard. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City Council makes <br />the following Findings of Fact in respect to SP-137: <br /> <br />1. The subject site is zoned R-2, two family residential. <br /> <br />2. A church is a special use in an R-2 district. <br /> <br />3. That the establishment, maintenance or operations of the special use <br />will not be detrimental to or endanger the pUblic health, safety, <br />morals, comfort or general welfare. <br /> <br />4. That the special use will not be injurious to the use and enjoyment <br />of other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values <br />within the neighborhood. <br /> <br />5. That the establishment of the special use will not impede the normal <br />and orderly development and improvement of the surrounding property <br />for uses permitted in the district. <br /> <br />6. That adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br /> <br />7. That the special use shall in all other respects, conform to the <br />applicable regulations of the district in which it is located. <br /> <br />BE IT FURTHER RESOLVED, that the application for SP-137 is and hereby <br />approved subject to the following conditions: <br /> <br />1. Conformance and adherence to all standards for special use permits <br />as pertains in Section 8-110 and 8-130 of the New Brighton Building <br />Code. <br /> <br />2.
