<br />.~ <br /> <br />RESOLUTION NO. 87~ <br /> <br />.. - ,- .,. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-253 (located at 1693 - <br />14 th Avenue NW). <br /> <br />WHEREAS, an application for a variance has been made by David and <br />Beverly Haugen; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New <br />Brighton on April 3, 1987. <br /> <br />2. The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing on April 21, 1987, and all <br />persons present at the hearing were given an opportunity to be <br />heard. <br /> <br />3. The application for a variance was reviewed by the City <br />Council on April 28, 1987. <br /> <br />NOW THEREFORE BE IT RESOLVED, the Planning Commission makes the <br />following Findings of Fact in respect to VN-253: <br /> <br />1. That the property is zoned R-1, Single Family Residential. <br /> <br />2. That the required lot width and lot area in an R-1 zoning is <br />75 feet and 10,000 square feet respectively. <br /> <br />3. That the applicant is requesting a 9 foot Lot width variance <br />and a 1,097 square foot lot area variance to construct a <br />single family home on the subject lot. <br /> <br />4. That the site is an area that was originally platted for <br />cottage development with small lots and narrow streets. <br /> <br />5. That applicant has exhausted all reasonable efforts to <br />increase the lot width and area of the subject lot. <br /> <br />6. The RCWD granted the applicant a 16 foot normal highwater mark <br />setback variance resulting in a 34 foot NHWM setback. <br /> <br />7. The property would be undevelopable without approval of the <br />lot width and lot area variances. <br /> <br />8. That the applicant has demonstrated unique and unusual <br />circumstances and undue hardship for the variance request. <br /> <br />BE IT FURTHER RESOLVED, that application VN-253 is hereby approved <br />conditioned on: <br /> <br />1. The construction of any and all structures on the subject lot <br />conform to the district FAR of 30 percent and setbacks of 30 <br />feet from the front property line and 5 feet from the side and <br />rear property lines. <br /> <br />2.
