R7-?Q <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF UTILITY <br /> <br />EASEMENTS located on the United Theological Seminary property at 3000 ~ 5th <br /> <br />Street N.W. <br /> <br />WHEREAS, the United Theological Seminary of the Twin Cities has sub- <br /> <br />divided a portion of its property located at 3000 - 5th Street N.W. and <br /> <br />platted said property as Seminary Estates, said plat having been filed in the <br /> <br />office of the Ramsey County Registrar of Titles in Book 36 of Plats, pages 8, <br /> <br />9 and 10 as Document No. 817630; and <br /> <br />WHEREAS, the process of subdividing the land has resulted in a relocation <br /> <br />of some of the existing utilities eliminating the need for one easement and <br /> <br />enabling a second easement to be dedicated on the subdivision plat; and <br /> <br />WHEREAS, the following described easements are no longer needed and <br /> <br />should be vacated to clear up and simplify the legal description of the new <br /> <br />lots in the subdivision; and <br /> <br />WHEREAS, the City Council, pursuant to published and mailed notice held a <br /> <br />public hearing on October 28th, 1986, and all persons present at the hearing <br /> <br />were given an opportunity to be heard. <br /> <br />1. A 20 foot permanent easement for utility purposes over, under <br />and across a part of Seminary Estates as evidenced by a Utility <br />Easement dated May 21, 1977, and filed in the office of the <br />Ramsey County Registrar of Titles as Document No. 640264. <br /> <br />2. A 20 foot permanent easement for utility purposes over, under <br />and across a part of Seminary Estates as evidenced by a Utility <br />Easement dated May 21, 1977, and filed in the office of the <br />Ramsey County Registrar of Titles as Document No. 640307. <br />
