<br />RESOLUTION NO. 86-133A <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHrr'ON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN APPLICATION <br />FOR VN-25l <br /> <br />WHEREAS, an application for a variance entitled VN-25l has <br />been made by First General Services to permit an office/warehouse building <br />and accessory parking to be located 410 feet from an R-3A, multi family <br />residential district; and <br /> <br />WHBREAS, the procedural history of the application is as <br /> <br />follows: <br /> <br />1. That an application for VN-25l was filed with the City of <br />New Brighton on October 31, 1986. <br />2. 1bat the Planning Commission, pursuant to published and <br />mailed notices, held a public hearing on November 18, 1986, <br />all person's present at the hearing were given an opportunity <br />to be heard. <br />3. That such application was reviewed by the City Council <br />on November 25, 1986. <br />4. The written comments and analysis of the City Staff, <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br /> <br />1. That the property is zoned I-I, light industrial. <br />2. That the property directly to the south is zoned R-3A, <br />multiple family residential. <br />3. That section 6-1360(c) states that an industrial district <br />sideyard adjacent to a residential boundary line shall <br />provide for a 610 foot landscaped area to provide screening. <br />4. That the applicant is requesting a 210 foot variance along the <br />south property line. <br />5. That the site is long and narrow, slopes to the east, is <br />partially located in the floodplain, and has poor soils <br />which combine to restrict the buildable area of the site. <br />6. That the requirement for a 610 foot landscaped strip along the <br />south property line further reduces the buildable area of an <br />already narrow site. <br />7. That the existing apartment building is located approximately <br />410 feet from the south property line of the proposed <br />development (810 feet from the proposed new structure). <br />8. That the applicant will suffer undue hardship if the variance <br />be sufficient to construct an industrial building and drive <br />access, and off-street parking. <br />9. That the applicant has demonstrated unique and unusual <br />circumstances and undue hardship for the variance request. <br /> <br />BE IT FURTHER RESOLVED, that the application VN-251 is hereby <br />approved subject to the following conditions: <br /> <br />1. Approval of LP-204. <br />2. That all grading and drainage plans be approved by the City <br />Engineer. <br />3. That a six foot cyclone fence be constructed according to <br />code along the south property line. <br /> <br />Adopted this 25th day of November, 1986. <br /> <br />ri: ..
