<br />6. The thermal processor incineration process has been formally approved <br />by the Minnesota pollution Control Agency (MPCA) and Bell Lumber and <br />Pole Company has been issued permits from both the Solid Waste Divi- <br />sion and the Air Quality Division of the MPCA to operate the thermal <br />processor. <br /> <br />7. The on-site incineration process would comply with the New Brighton <br />zoning Code, Section 8-130 (a) , (b), (c), (d), and (e), Special use <br />permit standards, and Section 6- 390(f),(g), (h), and (i) regarding <br />performance standards in the 1-2 district. <br /> <br />8. The thermal processor incineration process has been endorsed by the <br />New Brighton Environmental Quality Commission and formally approved <br />by the Minnesota Pollution Control Agency (~WCA) and Bell Lumber and <br />Pole Company has been issued permits from both the Solid Waste Divi- <br />sion and the Air Quality Division of the MPCA to operate the thermal <br />processor. <br /> <br />9. A 50 x 80 foot metal structure would be constructed to accorrmodate <br />the rotary kiln thermal processor on a temporary basis. <br /> <br />10. The on-site incineration process is scheduled to be completed by <br />August 1, 1988, and the rotary kiln thermal processor and metal <br />structure is scheduled to be removed from the site by January 1, <br />1989. <br /> <br />11. The uses and structures on the site are Type IV non-conformities <br />which could not be expanded on a permanent basis without first <br />securing a proper permit therefor. Furthermore, because of its <br />temporary nature, the proposal has not undergone site plan review <br />to consider such matters as parking and landscaping. Therefore, <br />this permit would not be granted but for the facts that the use <br />is to be on a temporary basis only and that there is a compelling <br />need to provide for the correction of contaminated soils prob- <br />lems. <br /> <br />BE I'r FURTHER RESOLVED, that the application SP-135 is hereby <br />approved until January 1, 1989, conditioned on: <br /> <br />1. A fire hydrant being placed on the site prior to operation of the <br />incinerator. <br /> <br />2.
