<br />1..".: <br /> <br />Ii <br /> <br />",. <br /> <br />RESOLUTION NO. 86-121 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY Of NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-Z49 (generally <br />located north of 21st Street NW and west of 27th Avenue NW). <br /> <br />WHEREAS, an application for a street sfdeyard setback variance <br />has been made by Wflliam Barbush, and <br /> <br />WHEREAS, the procedural history of the applfcation is as follows: <br /> <br />1. That an appllcatfon for VN-249 was ffled wfth the City of New <br />Brighton on October 17, 1986. <br /> <br />2. That the City Council, pursuant to publfshed and mafled notices, <br />held a pUblic hearing on Noveroer 10, 1986, all persons <br />present at the hearing were given an opportunfty to be heard. <br /> <br />3. That such application was reivewed by the Plannfng Commission <br />on October 21, 1986. <br /> <br />4. The wrftten comments and analysis of the city staff, the Planning <br />Commission minutes and recommendations were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED by the City Council that the following <br />Ffndings of Fact are made in respect to VN-Z49. <br /> <br />1. That the property fs zoned R-2, Two-family Residentfal. <br /> <br />2. That the requfred street sideyard setback for a corner lot in <br />the R-Z distrfct Is 30 feet pursuant to Sectfon 4-240 (c) of <br />the zoning code. <br /> <br />3. That the applfcant is requestfng an 18 foot street sideyard <br />setback. <br /> <br />4. That the subject site fs part of the approved PRD-27. <br /> <br />5. That the 18 foot street sideyard setback complfes with the <br />intent of PRD-27 when approved prfor to August 21, 1981. <br /> <br />6. That PRD-27 was approved prfor to changing the sfdeyard <br />setbacks to 30 feet. <br /> <br />7. That not granting thfs varfance would reduce the number <br />of lots and number of units approved fn the overall PRO. <br /> <br />8. That a prevfous proposal for a 15 foot sideyard setback <br />has been approved for the parce I . <br /> <br />BE IT FURTHER RESOlVED that the applicatfon VN-Z49 is and hereby <br />approved subject to the followfng condftfons: <br /> <br />1. That the proposed plat PL-150 be given ffnal plat approval by <br />the New Brighton Cfty Councfl. <br /> <br />2. Drfveways for the proposed lots be off of 21st Street NW. <br /> <br />3. Lot 8 wfll requfre a 15 foot sidyard setback varfance in <br />order to be buildable and that this variance would be <br />compatible with the 15 foot sfdeyard setback varfance for <br />Lot 9, Block 2, Park Place. <br /> <br />Adopted this lOth day of November, 1986. <br /> <br />ATTEST: <br /> <br />~ <br /> <br />/ <br /> <br /> <br /> <br />.
