<br />--!. <br /> <br />L i... _ ~~ <br /> <br />RESOLUTION NO. 86-108 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION OF UTILITY <br />EASEMENTS located on the United Theological Seminary property at 3000 - 5th <br />Street NW. <br /> <br />WHEREAS, the United Theological Seminary has subdivided a portion of <br />its property located at 3000 - 5th Street NW and, <br /> <br />WHEREAS, the process of subdividing the land has resulted in a reloca- <br />ation of some of the existing utilities eliminating the need for one ease- <br />ment and enabling a second easement to be dedicated on the subdivision plat <br />and, <br /> <br />WHEREAS, the following described easements are no longer needed and <br />should be vacated to clear up and simplify the legal description of the new <br />lots in the subdivision; and <br /> <br />WHEREAS, the City Council, pursuant to published and mailed notice <br />held a public hearing on October 28th, 1986 and all persons present at the <br />hearing were given an opportunity to be heard. <br /> <br />1. A 20 foot permanent easement for utility purposes over, under and <br />across Tracts "B and 0" in said Registered Land Survey No. 214, <br />Ramsey County, Minnesota. The center line of said easement is <br />described as follows: Commencing at the Southwest corner of said <br />Tract "B" thence East along the South line of said Tract "B" a dis- <br />tance of 994.28 feet. Thence North 683 feet; thence West 57.5 <br />feet; thence North along a line to its intersection with a line 10 <br />feet southwest of and measured at a right angle to and parallel <br />with the Northeasterly line of said Tract "0". Thence Northwest- <br />erlya10ng a line 10 feet Southwest of, and measured at right <br />angles to and parallel with the Northeasterly lines of said Tract <br />"0" to the North line of said Tract "0" AND said center line there <br />terminating. <br /> <br />2. A twenty (20) foot PERMANENT EASEMENT for Utility purposes over, <br />under and across TRACT "C", REGISTERED LAND SURVEY NO. 214, RAMSEY <br />COUNTY, MINNESOTA. The center line of said EASEMENT IS described <br />as follows, viz: <br /> <br />Beginning at a point on the north line of said TRACT "C" distant <br />206.45 feet WEST of the NORTHEAST CORNER THEREOF, said north <br />line having an assumed bearing of EAST-Thence South 41 degrees, <br />11 minutes East 75 feet, and said center line thereof terminat- <br />ing. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NEW <br />BRIGHTON THAT THE ABOVE DESCRIBED EASEMENTS AS EVIDENCED BY DOCUMENTS NO. <br />640307 AND 640264 RAMSEY COUNTY REGISTRAR OF TITLES ARE HEREBY VACATED. <br />THIS VACATION DOES NOT AFFECT STREET AND UTILITY EASEMENTS DEDICATED IN <br />CONNECTION WITH THE PLATTING OF SEMINARY ESTATES WHICH EASEMENTS REMAIN IN <br />FULL FORCE AND EFFECT.
